General Information

The Central Department on Lawmaking in State Development is a unit of the Ministry of Justice that takes part in legal support of law-making activities of the President of the Republic of Belarus, the National Assembly of the Republic of Belarus and the Council of Ministers of the Republic of Belarus, coordinates law-making process within governmental bodies.

Lawmaking in the sphere of state development deals with the following areas of legislation:

  • on the fundamentals of the constitutional system, constitutional rights, freedoms and duties of a person;

  • on state languages, state symbols, official heraldic symbols, heraldic service;

  • about the territory;

  • on the population, the legal status of foreign citizens and stateless persons, migration;

  • on the electoral system, referendums;

  • on the President of the Republic of Belarus;

  • on the Parliament – the National Assembly of the Republic of Belarus, on local government and self-government bodies;

  • on bodies of executive power, local executive and administrative bodies,

  • on the bodies of the judiciary, the judiciary, the status of judges and people's assessors;

  • on supervisory bodies;

  • on the Bar, on the notary;

  • on lawmaking;

  • on applications of citizens and legal entities, on the basics of administrative procedures;

  • on civil and economic process, international civil and economic process;

  • on administrative offenses and administrative responsibility, procedural and executive legislation on administrative offenses;

  • criminal, criminal procedure, criminal enforcement legislation;

  • on law enforcement, fighting crime and forensic work;

  • in the sphere of defense and in the military sphere, on arms, military and special equipment, on defense, military and other objects; on military duty and military service, alternative service;

  • about the civil service;

  • on national security;

  • on state awards; on measures of encouragement for services to the Republic of Belarus;

  • on state holidays, holidays, commemorative and anniversary dates, perpetuation of memory;

  • on trade unions;

  • about architectural and town-planning activity;

  • on labor and employment of the population;

  • about marriage and family;

  • on acts of civil status;

  • housing legislation;

  • on the improvement and maintenance of settlements, burial and funeral activities, communal services;

  • on social protection and social insurance;

  • on health care, sanitary and epidemiological welfare of the population;

  • on education, on scientific, technical and innovative activities;

  • information, information and protection of information, information technology, electronic documents;

  • about culture, physical culture, sports and tourism.

Main objectives

  • to participate in the legal support of lawmaking activities of the President of the Republic of Belarus, the Parliament – the National Assembly of the Republic of Belarus and the Government – the Council of Ministers of the Republic of Belarus;

  • to coordinate lawmaking in the Government of the Republic of Belarus (in the system of governmental bodies);

  • to make proposals on the improvement and development of the legislation of the Republic of Belarus on the basis of analysis of legislation, law enforcement practice and theoretical research in the field of law;

  • to draft legal acts;

  • to conduct legal expertise of draft resolutions of the Council of Ministers of the Republic of Belarus;

  • to coordinate draft laws of the Republic of Belarus, decrees and edicts of the President of the Republic of Belarus;

  • to participate in the codification and systematization of the legislation of the Republic of Belarus, as well as in the preparation and implementation of annual plans for drafting bills;

  • to participate in the harmonization and unification of the legislation of the Republic of Belarus with laws of foreign states within the framework of international organizations in accordance with treaties of the Republic of Belarus;

  • to participate in the resolution of other important issues of the government in accordance with the legislation of the Republic of Belarus.

Main functions
  • to monitor lawmaking activities in ministries and other governmental bodies, to prepare submissions on the elimination of violations of lawmaking activities identified as a result of the monitoring;

  • to overview the practice of drafting normative legal acts;

  • to examine the practice of applying the legislation of the Republic of Belarus, develop proposals for improving the legislation of the Republic of Belarus and submit them to the Deputy Minister of Justice, the Minister of Justice;

  • to consider appeals of citizens, individual entrepreneurs and legal entities;

  • to prepare conclusions of mandatory legal expertise of draft resolutions of the Council of Ministers of the Republic of Belarus;

  • to propose the possibility of making consent on draft laws of the Republic of Belarus, decrees and edicts of the President of the Republic of Belarus;

  • to coordinate the implementation of the decisions of the Constitutional Court of the Republic of Belarus, taken as a result of the mandatory preliminary control of the constitutionality of laws;

  • to take part in carrying out measures to improve the qualification of employees of legal services of state bodies;

  • to participate in scientific events (forums, conferences, workshops), including those organized by international organizations;

  • to participate in the legal education of the population, including through the mass media, to interact with the media in order to cover activities;

  • to represent the interests of the Ministry of Justice of the Republic of Belarus in relations with other organizations;

  • to exercise other functions in accordance with the legislation of the Republic of Belarus, including resolutions of the Ministry of Justice of the Republic of Belarus, and also orders and instructions of the Minister of Justice of the Republic of Belarus.
