The Commission on Implementation of International Humanitarian Law

STATUS AND MAIN AIMS

The Commission on Implementation of International Humanitarian Law under the Council of Ministers of the Republic of Belarus was established to fulfill the obligations of the Republic of Belarus , arising from the Geneva Conventions for the Protection of Victims of War of 1949 and their Additional Protocols of 1977, as well as at preparing of proposals on the implementation of rules of IHL into national legislation.
The Commission is a permanent consultative interdepartmental working body of the Government of the Republic of Belarus.
The Commission exercises coordination of the activity of state bodies and organizations in the sphere of the implementation of rules of IHL into national legislation; advances cooperation with similar commissions of other states as well as with the International Committee of Red Cross.
The main aims of the Commission are:

  • study and consideration of national legislation of the Republic of Belarus for its conformity with rules of IHL;
  • promotion of bringing of the national legislation to conformity with the international treaties in the sphere of IHL to which the Republic of Belarus is a party;
  • preparation of consultative opinions on drafts of international treaties and on legislative acts of the Republic of Belarus in the sphere of IHL;
  • assistance in dissemination of knowledge of IHL.

The responsibilities of the Commission include preparation and submission to the Government an annual report on the state and tendencies of fulfillment of international obligations of the Republic of Belarus in the sphere of IHL.

HISTORY OF ESTABLISHMENT

Nowadays more then 35 countries of the world established state bodies to encourage implementation of the International Humanitarian Law.
The Government of the Republic of Belarus established the Commission on Implementation of the International Humanitarian Law under the Council of Ministers of the Republic of Belarus by the Decision № 1242 of September 19, 1997.
Originally the Commission was headed by the Deputy Prime-Minister of the Republic of Belarus. Since 2002 the organizational security of the Commission’s activity is entrusted to the Ministry of Justice of the Republic of Belarus and the Commission is headed by the Minister of Justice of the Republic of Belarus.

LEGAL BASIS OF ACTIVITY

The legal base of the activity of the Commission on Implementation of the International Humanitarian Law under the Council of Ministers of the Republic of Belarus consists of the following regulations:

  • On creation of the Commission on Implementation of the International Humanitarian Law under the Council of Ministers of the Republic of Belarus - Decision of the Council of Ministers of the Republic of Belarus № 1242 of September 19, 1997;
  • On approval of the Regulations of the Commission on Implementation of the International Humanitarian Law under the Council of Ministers of the Republic of Belarus - Decision of the Council of Ministers of the Republic of Belarus № 104 of January 26, 1998;
  • Questions of the Commission on Implementation of the International Humanitarian Law under the Council of Ministers of the Republic of Belarus - Decision of the Council of Ministers of the Republic of Belarus № 319 of March 12, 2002.

SECRETARIAT

All the office work as well as preparation of materials for sessions of the Commission is performed by its Secretariat, which functions are entrusted to the International Сooperation Department of the Ministry of Justice of the Republic of Belarus. The Secretary of the Commission conducts the work of the Secretariat.
